Common Sense Regulation, NOT Prohibition: What NC's Looming Hemp Ban Means for You
A message from Franny's Farmacy Raleigh
If you've shopped with us before, you already know we take product safety seriously; lab testing, age verification, and honest labeling aren't optional at Franny's Farmacy, they're the standard. That's exactly why we're asking you to pay close attention to what's happening at the General Assembly right now.
On July 2, 2026, the North Carolina Senate voted 37–6 to approve the conference report for House Bill 328, legislation that would functionally outlaw an estimated 99% of the hemp products currently sold on our shelves. The bill now heads to the House, which reconvenes on July 27, 2026. If it passes there and is signed by Governor Josh Stein, the new rules would begin taking effect this fall — with the most severe restriction, a near-total product ban, kicking in on November 12, 2026.
We believe North Carolina needs real regulation of this industry: strict age limits, mandatory lab testing, and honest labeling. What we don't believe in is prohibition dressed up as public safety. Here's what you need to know, and how you can make your voice heard before it's too late.
What HB 328 Actually Does
- Redefines "hemp" using a total-THC standard instead of the current delta-9 threshold, capping any finished product at 0.4 milligrams of total THC per container — a limit so low that most gummies, drinks, vapes, and flower products on today's market would no longer qualify as legal hemp.
- Reclassifies non-compliant products as Schedule VI controlled substances, the same legal category as marijuana, effective November 12, 2026.
- Sets a 21+ purchase age for hemp and kratom consumables, with civil fines ranging from $2,500 to $50,000 for violations and criminal exposure for anyone caught manufacturing, selling, or possessing banned products after the deadline.
- Aligns the state with a forthcoming federal hemp definition, and notably would not automatically loosen up even if Congress later delays or waters down that federal rule.
We support the age-verification piece wholeheartedly — nobody wants these products in the hands of minors. It's the blanket 0.4mg container cap that effectively bans the entire legal, tested, adult-use market rather than regulating it.
What's Actually at Stake for North Carolina
The numbers here aren't abstract. They represent our farmers, our neighbors, and our own communities.
- A $3.2–4.4 billion industry. According to a Whitney Economics report, North Carolina's hemp sector generates roughly $3.2 billion in annual revenue and supports a $4.4 billion total economic footprint, employing more than 16,000 people statewide.
- Retail collapse. With around 2,197 dedicated hemp storefronts operating in the state, industry analysts project that 75–90% of dispensaries and vape shops could close within 90 days of a ban taking effect. This means a wave of small business closures, commercial lease defaults, and unsellable inventory sitting on shelves, and bankruptcy for your favorite dispensaries, and unemployment of over 16,000 NC hemp industry workers as it becomes a controlled substance overnight.
- Farmers left holding the bag. Thousands of former tobacco farmers pivoted to hemp as a lifeline, investing in specialized greenhouses, drying barns, and extraction equipment that can't easily be repurposed for other crops. A sudden ban threatens to strand that investment and push family farms toward foreclosure, right as standing crops in the field become illegal to harvest or sell.
- A black market, not a solved problem. Consumer demand doesn't vanish because a product becomes illegal, it goes underground. Without regulated retailers doing age verification and third-party lab testing, products move to unregulated, untested channels, which several lawmakers, including Sen. Sophia Chitlik (D-Durham), have warned will make the youth-access and safety problems worse, not better.
- Losing the tax base to our neighbors. Virginia is launching a legal, adult-use cannabis retail market on July 1, 2027, with a 6% state cannabis tax (rising to 8% in 2029). South Carolina's hemp market remains almost entirely unregulated. If North Carolina bans its own market instead of taxing and regulating it, consumers and revenue are likely to simply cross state lines, leaving North Carolina with none of the tax revenue and all of the lost jobs.
The Common Sense Alternative
Nobody serious about this issue, including many hemp dispensaries like us, thinks the current "anything goes" landscape should continue unchanged. But there's a well-established regulatory model already sitting right next door: alcohol. NC's ABC system generated nearly $1.9 billion in sales and roughly $713 million in public revenue in FY2023–24 precisely because it's regulated and taxed, not banned.
A smarter path forward could include:
- Strict, enforced 21+ age verification at every point of sale (something we already do)
- Mandatory third-party lab testing for potency and contaminants, with results available to consumers (like other agriculture safety requirements)
- Clear, honest labeling and packaging that isn't designed to appeal to kids
- A reasonable, defined THC limit set through consultation with the industry and public health experts — not a threshold so low it erases the legal market entirely
- A state excise tax framework, similar to what's been proposed for hemp-derived consumables, that funds enforcement and public revenue instead of driving it to Virginia and South Carolina
This is what "common sense regulation, not prohibition" looks like in practice: a legal, tested, taxed market that protects kids and consumers while keeping North Carolina farmers, workers, and small businesses in business.

House Bill 328 is now in the hands of the NC House of Representatives, which returns to session on July 27, 2026. This is the moment to call or email your representative and ask them to support real regulation-age limits, testing, and labeling, instead of a ban that hands North Carolina's market to its neighboring states and pushes it underground. While there are lobbyist groups advocating for hemp, there are others fighting against it (like corporate medical marijuana, and alcohol).
Representatives must tally all the incoming calls, emails, and snail mail to gauge public sentiment in their districts so your voice REALLY matters right now.
