When Congress quietly passed the 2026 Appropriations Bill, it included one line that sent shockwaves through the hemp industry:

“Prevents the unregulated sale of intoxicating hemp-based or hemp-derived products, including Delta-8, from being sold online, in gas stations, and corner stores…”

Let’s be clear: This is not regulation—it’s prohibition.

In the days since the ban was signed, Franny Tacy and her team have been hard at work , rallying alongside cannabis attorneys, advocates, lobbyists, and business owners to protect the future of hemp.

“This is about protecting access, protecting farms, and protecting freedom. We’re fighting for regulation , not a blanket ban that punishes good actors,” says Franny.

The ban doesn’t go into full effect until November 2026 , which means:

  • We have one year to fight, adapt, and rewrite the rules
  • State lawmakers and regulators will decide how this plays out locally
  • The federal government cannot enforce this alone —it will unfold state by state
  • Hemp and CBD products are still legal and safe to purchase right now
